1. Introduction

Welcome to CueWise. These Terms of Service govern your access to and use of the CueWise website, account features, missed-question uploads, AI analysis, Error Cards, Pattern Reports, paid analysis quota, and related services.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

CueWise is an AI missed-question diagnosis tool for NCLEX-RN and registered nurse candidates. It is not a question bank, course platform, public study community, or generic notebook. The Service helps you review missed NCLEX-style questions you provide and identify repeated clinical judgment patterns.

• Upload single-question text, images, or eligible PDF materials.
• Receive concise Error Cards with Suggested Answer, Core Point, Knowledge gap, Blind Spot, and Tags.
• Generate Pattern Reports after enough valid analyzed questions.
• Purchase and use analysis-count quota.
• Download or share milestone effort images that show effort, not weaknesses.

3. User Accounts

Certain features require an account. When creating and using an account, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information to keep it accurate
• Accept all risks of unauthorized access to your account
• Be at least 18 years old or the age of legal consent where you live

You are responsible for activity under your account. Do not impersonate another person, resell account access, or use the Service in a way that harms security, availability, or other users.

4. Uploaded Content and Acceptable Use

You retain your rights in content you upload. You give CueWise a limited license to process that content only as needed to provide, maintain, protect, and improve the Service for your account.

• Upload only study materials you have the right to use.
• Do not upload patient private information, clinical records, or protected health information.
• Do not upload malicious code, unlawful content, infringing content, or non-NCLEX study material.
• Do not bypass access limits, quota limits, payment flows, or security controls.

5. AI Output and Study Use

AI output from CueWise is a study aid. It is not medical advice, nursing practice advice, official exam guidance, or a guarantee of exam performance. AI output may be wrong, especially when a question is incomplete, image quality is poor, OCR is uncertain, or the answer source conflicts with the reasoning.

CueWise is an independent study tool. Missed-question analysis is powered by Evolink AI and built on the configured Gemini 3.5 Flash model (gemini-3.5-flash).

When the Service marks an item as Needs confirmation, you should confirm the question, answer options, or answer source before relying on the result. CueWise is not affiliated with or endorsed by Google, Gemini, NCSBN, NCLEX, any model provider, or any exam authority.

6. Payment Terms

Paid products are measured in analyses. One valid analyzed question generally uses one analysis. Upload failure, extraction failure, non-NCLEX content, or Needs confirmation before analysis generally does not consume analysis quota.

Analysis quota is granted only after payment webhook confirmation from the payment provider. Quota batches may have expiration dates and are consumed earliest-expiration first. Expired unused analyses do not roll over.

7. Refunds

Refund terms are described in our Refund Policy. Used analyses are generally not refundable. Mistaken purchases and billing errors should be reported to support promptly. Nothing in these Terms limits refund rights required by applicable law.

8. Intellectual Property Rights

The CueWise website, interface, product name, service logic, software, design, and original content are owned by CueWise or its licensors. You may not copy, reverse engineer, sell, or build a competing service from them without permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Uploads are private to your account and are not used to build a public question bank, share original question content across users, or train shared models.

10. Termination

We may restrict, suspend, or terminate access if you violate these Terms, misuse the Service, infringe others' rights, engage in fraud, or create security risk. You may request account deletion through support.

11. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RN PATTERN COACH DISCLAIMS WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FIT FOR YOUR SPECIFIC PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RN PATTERN COACH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Changes and Governing Law

We may update these Terms from time to time by posting a new effective date on this page. For material changes, we will make reasonable efforts to provide notice through the Service, email, or another appropriate channel.

These Terms are interpreted under applicable laws of the United States, without regard to conflict of law rules. Any dispute will be handled in a court or forum with proper jurisdiction.
